These terms and conditions, apply to the usage of the Website and all transactions for the sale of goods on the Website. Please read them carefully. They do not affect your statutory rights. Appendix A – How to place an order

1. Provision of Website Service

The Website is owned and operated by Mula Cake Ltd (Company number 8275049 …………), ('Mula Cake ') whose registered office is at 61 Milkwood Road, London SE24 0HY ; place of registration - England. All products offered for sale on this website are offered by Mula Cake Ltd. which will be the contracting party for any order that you place.
2. Limited Rights to Use Content
2.1 All material including any intellectual property in it displayed on the Site ("Content") belongs to Mula Cake or its suppliers. Subject to section 2.2, we give you the right, for your own personal or non-commercial purposes only to:
• Retrieve and display the Content on your PC screen.
• Print individual pages on paper.
• Store individual pages in electronic form on disk/CD.
You do not have the right to store any Content on any server or other storage device connected to an external network. Or make any other use of the Content.
2.2 Most of the Content is owned by Mula Cake but certain Content is used with the permission of third parties ("Third Party Content") and may be subject to additional restrictions. These restrictions and/or intellectual property rights will be highlighted through hyperlinks on the appropriate pages. You must comply with such restrictions and/or copyrights.
2.3 You may not, without prior written permission from Mula Cake given within the previous 6 months:
• Redistribute any of the Content or supply it to other people.
• Remove the copyright or trade mark notices from any copies of Content made under this Agreement.
• Create a database in any form (including electronic or structured manual form) by downloading, copying and storing all or any of the Content.
• Except as expressly set in this Agreement, modify, reproduce or in any way use any of the Content.

3. Participation

3.1 Mula Cake allows you to submit material to certain areas of the Website. Mula Cake reserves the right to delete, move and edit any material submitted. You are solely responsible for the material you submit to the Website and by submitting any material you agree that you will not submit any material that:
• Advertises or promotes any goods or services deemed to be in competition with Mula Cake .
• Reveals any confidential or sensitive information.
• Contains or links to any unlawful, threatening, abusive, libellous, indecent or otherwise illegal material.
• Contains any material which you do not have permission to use (including material which may be protected by copyright, trademarks, database rights or any other form of intellectual property right).
• Contains viruses or any other components with harmful or contaminating properties which may affect the Website or any equipment connected to it.
• Disguises your identity or impersonates any person or entity, including, but not limited to, a Mula Cake employee, or falsely claims or otherwise misrepresents your affiliation with a person or entity.
3.2 Mula Cake welcomes your comments, suggestions, ideas and other material you provide or send directly to us. By submitting material to the Website, you grant Mula Cake a perpetual royalty free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-licence any material you submit in whole or in part or in any form. You agree that you waive any moral rights you have in the material.
3.3 The Website contains material and content submitted by persons ("Users") over whom Mula Cake has no control. Mula Cake cannot guarantee the accuracy, integrity or quality of any such material. Some Users may breach these terms and post material that is misleading, untrue or offensive - you must bear all risks associated with and resulting from your viewing of such material.
3.4 Copyright of any software that is made available for download for the participation in the Website ("Software") belongs to Mula Cake , its suppliers or Third Parties. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Certain pages on the Website may also be subject to additional terms of use that will be made available clearly by hyperlink - you must comply with all such terms.

4. Online Shopping – Terms and Condition of Sale of www.MulaCake.com

4.1 Product Details, Prices and Promotions

We take great care to present the products on our website as accurately as possible.
The prices for goods displayed for sale on the Website are as set out on the Website and are inclusive of VAT. Where additional charges are made for delivery, they are clearly displayed. Prices and delivery charges displayed are valid and effective for the countries and regions we deliver to. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the Website. Similarly, Mula Cake stores are under no obligation to honour any price or promotion offered on this Website, should they differ from those in-store.
Although we endeavour to ensure that all pricing and delivery information on the Website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
We reserve the right to adjust prices, offers, products and specifications of products on the Website at our discretion at any time before (but not after) we accept your order. We reserve the right to withdraw any goods from the Website at any time. We will not be liable to you or to anyone else for withdrawing goods from the website.
The images you see depend on your monitor’s display and colour capability and may vary as a result. We are therefore unable to guarantee that the pictures of the products you see are an accurate representation of the actual items.

4.2 Ordering

Before placing an order you should read these terms and conditions of sale (Section 4) and in particular, the following:

• Ordering.
• Delivery Information.
• Cancellation and Returns Policy.
• Privacy Policy (Section 8).
All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or anyone else in those circumstances. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note that this email is an acknowledgement and is not an acceptance of your order.
Your order represents an offer to us to purchase a product. Mula Cake cannot accept your order until you have paid for it in full (including applicable delivery charges). Once you have completed an online purchase, if we are able to accept your order, we will send you an email confirming that the goods ordered have been dispatched to you, unless we have notified you that we do not accept your order or that you have cancelled it in accordance with our returns policy. At this stage payment will be taken and a binding contract between us will exist. In certain circumstances, (section 4.1, 4.4 and 4.5), it will be possible for either you or us to cancel the order. Please read those sections for more information.
Whilst we are under no obligation to accept your order, we would normally do so where:
• The product is available.
• The order reflects current pricing.
• Your credit/debit card is approved by your credit/debit card company.
• Your paypal account has been debited and we have received payment.
Upon payment, we will confirm acceptance of your order by email which will be sent to the email address you provide on your order details. Whether or not you receive this email, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.

 

4.2.3 Payments

Payment can be made by most major credit or debit cards. Payment will be debited from your account upon or shortly before dispatch of the goods to you.
You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be responsible for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal.
We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.
All card payments are processed by Pay Point using their “thawte” 100% secure system.

4.2.4 Availability

Our website links directly to our stock system. This means that items shown are in stock in our warehouse at the time you place your order. However there may be certain situations where items become unavailable. In the unlikely event of this happening we will inform you by email if any items you have ordered are unavailable. Please note we do not charge your credit or debit card for items not sent to you.

4.3 Delivery Information

What are your delivery charges or options?
FREE UK Mainland Standard Delivery when you spend over £100! (excluding Highlands)
FREE delivery - Spend £100 or more in a single transaction, and we will not charge you for standard delivery. Please allow 3 - 4 working days for delivery. Applies to the UK mainland excluding the Scottish Highlands. Please note: FREE delivery is not available for Next Day Delivery.

STANDARD delivery - Our standard delivery charge is £4.50 for orders up to a value of £100.00. Please allow 3 - 4 working days for delivery.
NEXT DAY delivery - Our Next Day delivery charge is £7.50. We use a courier, , who aims to deliver to you the next working day. This service is only available in the UK mainland. If you place an order before 12.00pm on a weekday, it will be delivered to you the following working day. If you place your order after 12.00pm, on a Friday, or any time on a weekend or Bank Holiday, please add another working day. A signature is required when we deliver your order with Next Day delivery.
A signature is required when we deliver your order via courier delivery.
Deliveries by Courier
Consignments are delivered anytime between the hours of 9:00am and 6:00pm. Unfortunately it is not possible to specify an am or pm delivery time.
• If nobody is available to accept the delivery our courier will leave a calling card giving you the opportunity to arrange a more convenient delivery time
• Our courier does not deliver on Saturday, Sunday or Bank Holidays.
Please note that we cannot be held responsible for courier delays outside of our control.

Non UK mainland and Scottish Highland delivery
Costs vary and are dependant on the size/weight/value of the product. Regardless of the items, you will be charged a standard courier fee. A full breakdown of these delivery charges is available on request. If the item can be sent via Royal Mail, we will endeavour to refund all, bar £4.50 for your postage. Please contact us if you are unsure if this applies to your order.

4.3.2 Europe

Depending on location and local Customs Authorities, European delivery can take up to 14 days after being dispatched and are subject to possible customs clearance and local charges.
All quoted delivery times are based on standard working days i.e. Mon - Fri (excluding public holidays etc.).

4.3.3 Rest of the World

A full breakdown of delivery locations and charges is available on request(Please note delieveries can take up to 14 days to arrive).

4.3.6 Delivery Status

If you have not received your order or it is late please contact us. We will use our reasonable endeavours to ensure that the estimated delivery times set out in Section 4.3 are met but we cannot accept any liability for late deliveries which are due to circumstances outside of our control.
Once the goods have been received by you, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.

4.3.7 Undeliverable packages

Occasionally we will have a package returned to us because the couriers were unable to deliver it to you. When this happens we will attempt to contact you to establish if you would like your order re-dispatching or refunding. If we cannot contact you within 2 weeks of receiving your parcel back into our warehouse we will issue a refund for the product.

 

4.3.8 What if only part of your order has arrived?

 

Before contacting us please check your paperwork to see whether there is more than one parcel – for example, if it says ‘1 of 2’ or ‘1 of 3’. This means that we were unable to package your entire order on one package and you should expect a further delivery within the next few days.

4.3.9 What if your order has not arrived at all?

Before contacting us, please check your emails from us or our courier. Please check your junk folder, and ensure that info@Mula Cake .com is added to your safe senders list. Then contact us quoting the order number and date of order. We will then track your order with the relevant party and inform you on the delivery status and next steps.

4.4 Online Shopping Cancellation and Returns Policy

We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item.
Our policy is to ensure that you are satisfied every time you purchase an item from www.Mula Cake .com. If you are unhappy with an item, please return it to us within 14 days of the date on the dispatch note that accompanies your order. Please ensure that you have taken reasonable care of it, the product is in an unused state, it is complete with original packaging and it has all of its original components.
If you wish to cancel your order, you can email returns@Mula Cake.com Please note that we cannot cancel an order once it has been dispatched.

 

4.4.1 How to return products once received

If you wish return a product you can :.
• Please fill in the Returns Form or Contact us by email (returns@Mula Cake .com) or write to us at Registered office: 61 Milkwood Road , London, SE24 6DG
once you have contacted us, you will be given instructions on how and where to return your purchase. We recommend that you use a secure delivery method which requires a signature upon receipt (such as via Royal Mail First Class Recorded Delivery) as you will be responsible for the returned products until they reach us.
You must contact us before sending any items back to us.
If we are notified of your intention to return a purchase within 7 days, we will refund the outgoing shipping costs. However we do not refund the cost of returning an item to us unless it is faulty.
All refunds are credited back to the credit card holder’s account which was used to make the original purchase.

4.4.2 Returning faulty products

Returning a faulty item is the same process as 4.4.1, no refunds or exchanges can be given on selected items until a manufacturing defect is identified. If an item is deemed to be faulty; we will refund the cost of both the outgoing and incoming mail.
If a manufacturing fault has not been determined, we will:
• Return the item to you.
We will always contact you before carrying out the above actions.

5. Limited Warranties

Mula Cake will use its reasonable skill and care in making sure that the Site is available to you on a continual basis. However, because of the number of sources from which Mula Cake obtains the Content and because of the nature of the Internet, Mula Cake does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and Mula Cake makes no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. Mula Cake (The Seller) warrants that the Goods will at the time of dispatch correspond to the description given by the Seller.

6. Subscribing to our mailing list

Our site's registration form requires users to give us their contact information (e.g. name and email address) in addition to some demographic information (e.g. postcode). If you request to receive information from Mula Cake , we will use customer contact information from the registration form to send you electronic newsletters or similar types of information.

7. Privacy Policy

Mula Cake is committed to protecting the privacy of those using our Site. The information that you provide about yourself to Mula Cake will only be used by Mula Cake Limited and related third parties in accordance with its Privacy Policy as set out below. We will treat all your personal information as confidential, and are committed to protecting your privacy. Any personal information which you provide to us is held in accordance with the Data Protection Act 1998.

7.1 Personal Information

We require personal details such as your name, address, email, debit/credit card, product and order details so that we can process your order and administer your account ( including taking steps to prevent fraud). We do not hold any credit card information.
Mula Cake uses third parties e.g. delivery providers, to assist with this who have access to limited personal information needed to perform their functions but may not use it for other purposes.
Unless it is necessary to fulfil your order or an order enquiry (including the delivery of goods you have ordered) or you have signed up for our email newsletter, we will not provide your personal information (i.e. information you supply that identifies you) to any external third party without your consent, or unless we are required to so by law.
Ways in which we might use your information to fulfil your order may include passing it onto employees and agents of the Group to administer any accounts, deliveries, products and services and passing it on to a technical partner to carry out processing of your personal information on our behalf.
We never make your personal details available to companies outside Mula Cake for marketing purposes, although our representatives and agencies may hold your data so that your details can be kept up to date, your orders processed and emails sent on behalf of Mula Cake .
If you sign up for our email newsletter, we use the personal information we collect about you to send you email newsletters featuring the latest promotional news, product information and in store activity. This information is held in compliance with the Data Protection Act 1998. If at any time you want to know what information Mula Cake holds about you, please feel free to contact us and we will provide you with details of all the information we hold about you. If you want to remove the information at any time, please let us know and we will remove it straight away.
If you have previously registered to receive our email newsletters you can remove your email address from the list by using the links in the emails we send you.

8. Technical
You should be aware that information and data may be automatically collected through the use of ‘cookies’. Cookies are small text files a website can use to recognise repeat users, allow us to observe behaviour, and compile aggregate data in order to improve our website and to target its advertising.

Mula Cake is continually seeking to improve the Site and services offered. Mula Cake reserves the right, at its discretion, to make changes to any part of the Site.

10. Links to other Websites

The Site contains links to other websites and resources. Mula Cake will make clear where such links are being made. Independent third parties provide these sites. Mula Cake is not responsible and shall not be liable for the availability or content of these outside resources. Please be aware that Mula Cake is not responsible for the privacy practices of other sites. We encourage our users to be aware when they leave our site and to read the privacy statements/terms and conditions of every website. The privacy policy highlighted in section 8 applies solely to information collected by Mula Cake .

13. General

13.1 There is no specific time limit applying to your access and use of the site. However, Mula Cake .com reserves the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.
13.2 You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.
13.3 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.
13.4 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.
13.5 English law will apply to this Agreement and both you and Mula Cake agree to submit to the non-exclusive jurisdiction of the English Courts. We are required by law to inform you that sales can be concluded in English only.
13.6 Waiver: No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

Appendix

A - How to place an order
When you have found an item you wish to purchase, select your required quantity, then click on 'Add to Cart’ and the item will be placed in your shopping cart. Click on 'Continue Shopping' to return to your previous page. You can then continue shopping until you have selected all the products you require. At any time you can check what you have chosen by clicking on 'Shopping Cart' where you can review and amend the quantities you have selected.
Once you have completed your selection, click on 'Shopping Cart'. Please note that to calculate your delivery charge, you need to select your delivery destination from the 'Country' drop down box. The appropriate delivery charge will be displayed. To proceed to checkout, click on the 'Checkout' button.
If you are an existing customer, to sign in simply click on the 'Login' button and enter the email address you registered with and your password.
If you are a new customer you can choose to register or to proceed to the checkout immediately without registering. If you register, this will save you time entering your name, address and delivery details the next time you order. We do not store any debit/credit card details at any stage.
To register with us please complete all the required Personal and Contact information, then choose and confirm a password. The password should be no more than 8 characters long and can be alphanumeric. We will send all correspondence regarding your order to the email address you enter in this form so please be sure to enter accurate contact information. We will only use this email address to communicate with you regarding your order, unless you have subscribed to receive our email newsletter. Any information is stored in compliance with Data Protection Legislation and we enforce strict internal security procedures to ensure compliance and prevent unauthorised access.
Complete the payment details, then please check your order, and enter your shipping and billing addresses. Your order can only be completed once you have read and agreed to the website Terms and Conditions. This is indicated by ticking the check box.
Once you are satisfied that everything is correct with your order click on 'Submit and Continue'.
Your order has now been placed. We will provide you with an order reference number, together with all the details you have already confirmed. Please print this order summary, and retain it as your reference. Your order will also be acknowledged by an email. When your order has been successfully dispatched, we will acknowledge this with another email.
